Affections of television program to children in each cognitive development stage. There are so many different television programs out there designed for children, but the reality is when the word â€Å"children† includes kids of the age between births to 12 years old, the affection of those programs must be different in different stages of cognitive development of children between births till the age of 12. Therefore, my paper is going to talk about how those affections are different in each stage of development and why should it be different by using specific examples of television program designed for children, and the theory of cognitive development from Jean Piage. While they discover the â€Å"ghost†, one child in the class found the fact of sounds is vibration; it helped him making his invented instrument for tomorrow’s concert. In order to understand the affections of this television program on each cognitive stage of children, I must introduce Jean Paige, a constructivist as well as an interactionist that developed a cognitive theory on children. He believed that children think and reason differently at different periods in their lives. He discovered that children are developed by passing through an invariant sequence that includes four distinct stages. The four stages are: sensorimotor, from birth to the age of 2; preoperational – 2-7 years old; concrete operational – 7-12 years old; and formal operational - 12 years and up. Start with sensorimotor stage, which include the children between 0-2 years old. This is the stage of cognitive development where kids have basic motor skills and learn how to move in the environment. The mental structures are mostly concerned with the mastery of concrete objects. Children in this stage of cognitive development would not be able to remember any moral or theme relates to The Magic School Bus-The Haunted House. Project X is a movie about three seniors who fly under the radar in high school. Costa and Thomas are best friends. Costa is loud, outgoing, and wants more than anything to be popular and have people know his name. Thomas is quite the opposite, he is more reserved and only concerned about a girl he likes. Thomas’ parents decide to go away for the weekend, which leaves the house free for Thomas’ birthday party. Thomas has many reservations about the party but allows it thinking that the girl he likes will show up. After many invitations are extended people begin to arrive. Things go from a controlled environment to absolute chaos, with the use of sex, drugs, and alcohol. The party once again continues with people jam packed in and around the house, dancing to loud music, and using drugs and alcohol. While this is happening the drug dealer, who owned the garden gnome, is coming down the street in protective gear holding a flame thrower, with rage in his eyes. The drug dealer uses the flame thrower setting everything on fire including Thomas’ parent’s house. The chaos of the party aftermath finally began to come to end and the boys took off away from the house like everyone else. The Effects of Human Activity on Climate free essay sample

Climate is a natural activity that can be defined as the weather conditions prevailing in an area in general over a long period of time (which can include temperature, air pressure, humidity, precipitation, sunshine, cloudiness, and winds) (â€Å"Climate†). The climate has been a part of our environment long before humans came to study it, and really took it into consideration. Now through the many negative environmental actions created by humans through beneficial human activities we have greatly come to change the natural flow that climate has on the environment. Human activity has such a dramatic affect on climate that our activities have already changed atmospheric characteristics such as temperature, rainfall, levels of carbon dioxide, ground level ozone, and shore areas like tidal zones (â€Å"Agriculture and Food Supply†). With these changes to our environment come natural devastating catastrophes like droughts, floods, and severe storms just to name a few. Through the evolution of our earth human beings have come up with so many technological advances (like transportations, use of CFS, and release of gases through factory productions just to name a few) that have bettered our society in many way, and in a sense have made life easier for mankind. However with all these new technological advances come damaging effects to the environment. Natural changes in climate result from interaction such as those between atmosphere and ocean (which is known as internal factors from external causes) (â€Å"Climate Change†). Prime examples of this are climate changes caused by human activities like heat trapping of gases, which are also known as green house gases. One of the biggest ways that people contribute to green house gases, and affect our climate is through burning fossil fuels, which is in turned used for technologies like generating electricity, heating of buildings and homes, powering factories, and fuel for our cars. A result of this is the massive amounts of carbon dioxide in earth’s atmosphere (â€Å"Climate Change†). Through all these proceedings we mess with our earth we mess with our home (niche), which is a serious issue, because earth is the only home known to all kinds. Also through the act of cutting down trees and deforestation, we had led to changing of climate because of the balance of nature being thrown off. Trees and other plants use carbon dioxide and give off oxygen. When trees are cut down for development, agriculture, and other purposes, they’re no longer available to take carbon dioxide out of the air, and actually release carbon dioxide as they decay or burn. Through these actions the levels of carbon dioxide and other greenhouse gases increase, more heat is â€Å"trapped† and global temperatures rise. This causes significant changes in the timing and length of the seasons as well as the amount and frequency of precipitation (â€Å"What is Climate Change†). Through all the harmful effects that humans beings have created on our environment to better our society that has lead to climate change is a serious issues and impacts on our planet both locally and globally. In 2007, the International Panel on Climate Change, studied the effects of global warming, and climate change, from those studies they estimated that sea levels could raise from 7-23 inches by the year 2100 (â€Å"What is Climate Change†). With this worldwide densely populated coastal communities and infrastructure that support them would be affected (such as city buildings, homes, roads, ports and wastewater treatment plants. This proves that climate change is a big issue, and that once it happens the effects of it may become irreversible, which could lead to life becoming very difficult for certain population of, animals, plants, and humans. This could eventually lead to movement or migration of individuals and species for survival, or possibly cause many species of animals to disappear, become endangered species or extinct. Ultimately it may lead to species, cultures, resources, and many lives being lost (Gosling et al 9). Even though human actions has caused our climate to change so much, we can still take control, and come up with plans to help reverse or lessen the severity of our proceedings and the way it affects the climate and the environment as a whole. One of the things that we can do to help save climate and the environment is just planting more. New plants and trees help to remove greenhouse gases like carbon dioxide from the air. Also through planting and growing your own food helps in preventing more carbon dioxide from entering the air from the fossils fuel burning trucks, planes, and ships which transport food from far away (â€Å"Global Climate Change†). This plan is so simple but yet effective, all it requires us to do is to just garden more. Everyone could start by investing just a few dollars in garden materials, and seeds. After obtaining all the materials necessary, the next thing to do would be to find an area (any area will do), after that the area would have to then be cleaned and cleared out. Finally the gardening process can be begun, and then cared and maintained each week. This would lead to incredible results, like eliminating green house gases, healthier food and air, and it would allow overall savings and certain groceries. Another very important action individuals can take that would benefit not only the environment, but also improve the severities that society has caused to our atmosphere is through reducing trash piles and garbage disposal. One of the first actions in this stewardship plan is buying reusable grocery bags. Through this massive amounts of plastic could be saved, and it would greatly help in eliminating the amount of trash pile each week. Recycling as much as possible is also a great way to help eliminate weekly trash, and greenhouse gases. Also through something simple as bringing you own mug when going to buy coffee or lattes in the mornings is a great way to use less paper and save trees (this plan is effective, because as previously stated trees help to reduce CO2 and provide O2). Drinking filtered or tap water as well as using reusable bottles can also help cut down on plastic and weekly trash. Finally buying products that use less packaging materials is a great way to cut down on energy, because it takes energy to create them, and energy to remake the packages into something new (â€Å"Global Climate Change†). Through the actions of planting more, and eliminating weekly trash we can great improve our environment through eliminating gases caused by factories, transport vehicles, and so much more (which in turn lead to pollution). These measures help to eliminate pollution from air, through eliminating pollution we help to maintain the natural climate patterns of temperature, precipitation, humidity, wind, and the seasons (â€Å"What is Climate Change†). As for stakeholder these actions would also benefit them, because they also live on this planet so clean air should be important to them as well. Also through recycling and using fewer products when packaging would help stakeholders save money as well, because they would not have to invest so much money in packaging their products. The overall success of these actions would be monitored by measuring whether or not the amounts of green house gases decrease, and finally by measuring and observing the climate changes and patterns. Climate is important to our environment, and it has a huge impact on life and the various life forms that come with it (known as biodiversity). This is because so many systems are tied to climate, so a change in climate can affect many related aspects of where and how people, plants, and animals live, such as food productions, availability and use of water, health risk and so much more. Through recycling, and planting, and other simple change and action we can help to eliminate the problems that cause climate change. Earth is our home, and we only have one environment so we should treat it with respect, because when we show it admiration it will respect us back.

Question: Discuss about the Exchange for Certain Essential Elements. Answer: Introduction: A contract is an exchange of promise, between two or more parties, where one party promises to do something, in exchange for consideration from the other party[1]. A contract can be an oral one or a written one. In case of an oral contract, the terms of the contract are exchanged in verbal manner. In the written contract, on the other hand, the terms of the contract are stated down on a document and signed by the parties to the contract[2]. In order to form a valid contract, it needs to have certain essential elements[3]. These include, an offer, an acceptance, consideration, intent, capacity and clarity regarding the terms of the contract[4]. An offer has to be made by one party, which has to be accepted by the other party. The offer has to be accepted as it was made; in case the in acceptance, the terms of the contracts are modified, then it is treated as a counter offer and not an acceptance. The acceptance has to be clearly communicated to the other party, and a mere silence cannot be treated as an acceptance. In the case of Felthouse v Bindley (1862)[5], the uncle has officered to purchase the home from his nephew and he stated that if he heard nothing from the nephew, he would consider the home as his. In this case, the court held that the acceptance was never communicated from the nephew, and mere silence cannot be treated as acceptance. So, a simple mental decision does not amount to acceptance[6]. Consideration is a crucial element of any contract, and without a consideration, a contract is void[7]. It can be anything which is decided amongst the parties, as long as it has some commercial value. The next essential is the intention of the parties to enter into legally binding contract and create legal relations[8]. The parties to the contract need to have the contractual capacity, i.e., they need to be of sound mind and legal age. The last essential is that there should be a clarity regarding the terms on which the contract is being established. Only when these elements are present in an agreement, a legally binding contract is formed[9]. When any party to the contract, fails to carry out the obligation which was imposed on them, due to the contract, then such party is held liable for a breach of contract. In such cases, the aggrieved party can initiate actions against such party, for breach of contract, and can apply for equitable or monetary damages. Monetary damages are in form on compensation and equitable damages are in form of specific performance and injunction[10]. In the present case, an offer was made by the university to attain police cover for the End of the Year Ball party. This offer was accepted by the police officers and a consideration was advised by the police officers, as the extra cost for the services of the police officers. Both the university and police had the legal capacity to enter into a contract. And they had the intention to enter into such legally binding relationship. There was a clarity regarding each aspect of the contract, and hence, a contract was formed. Since the terms of the contract were exchanged in a verbal manner and the offer and acceptance was in verbal manner, an oral contract was formed in this case. The university in this case believed that the services of the police officers in Victoria were free, even when Sergeant Ratty clearly communicated that this service of police officers would be charged. And the university never provided a counter offer or contested that it would not be paying the university, as this service was free as per their understanding. Taking inference from the case of Felthouse v Bindley, a mere silence cannot be treated as an acceptance, and even rejection of such fees. If the university refuses to pay the stated amount, it would breach the contract and this would allow the police to apply for contractual remedies in form of monetary compensation and specific performance. So, not only the university would be liable to pay the amount stated in invoice, by the reasons of specific performance, but would also be liable to pay compensation to the police for the hardship caused due to refusal of payment. After analyzing the facts of the case with the relevant law, it can be concluded that the university is indeed liable to pay the amount stated in the invoice to the police, otherwise it will be held in breach of contract, and would accordingly be liable for contractual remedies. The essential elements of a contract are offer, an acceptance, consideration, intent, capacity and clarity regarding the terms of the contract. Two of these, i.e., an offer and an acceptance are crucial elements of the contract. An offer has to be made by one party, which then has to be accepted, as was made, by the other party. A general rule is present regarding the acceptance that only when the acceptance is communicated and such communication is received by the other party, then it has to be deemed as acceptance[11]. But an exception to this rule is the postal rules. When the acceptance is given regarding an offer and such is communicated through the post, then the date of acceptance is taken as the date on which the acceptance was posted[12]. These rules apply only in such cases where the post is acknowledged as the means of acceptance. And, whether or not the other party received such post, is irrelevant[13]. The rationale behind this is that the parties nominate the post office as their implied agent, so the receipt of acceptance by the post office has to be taken as the receipt by the other party. In one of the established cases of Tallerman Co Pty Ltd v Nathan's Merchandise (1957)[14], the judges were of the view that the acceptance by post would not be justified; unless and until the offering party has grounds to believe that the offer can be accepted by use of postal means[15]. In another case of Byrne v Van Tienhoven (1880)[16], the judge was of the view that the post office acts as an agent of the person posting the acceptance; and that the delivery made to the post office has to be taken as the delivery made to the other party[17]. Further, in case where a revocation of an offer has to be made, where the offer was made in postal form, then the revocation would only be effective, if it was received by the other party before they post the acceptance letter[18]. In the given case, the offer was made by Welwisha to Dowell through a telegram regarding the appointment as the senior accountant for the firm. It was further stated in the telegram that the formal letter of appointment was in the mail. And when Dowell received this communication, he posted his acceptance letter to the offer of the committee. So, a valid offer was made and the acceptance was validly communicated. Applying the case of Tallerman Co Pty Ltd v Nathan's Merchandise here, there was presence of clear grounds to believe that the offer could be accepted by use of postal means, as the means of post was used for making the offer. Moreover, applying the case of Byrne v Van Tienhoven, the post office was the agent of Welwisha while making the offer and Dowell while accepting the offer, and so the date of posting of acceptance would be deemed to be the date of acceptance by Dowell. After the letter was posted by Dowell, the committee met again and decided against appointment of Dowell. But this was never communicated to Dowell. Moreover, the revocation of an offer has to be sent before the acceptance is received on an offer. Consideration is the next element, which is deemed to be present in the letter of appointment. The parties had the intention to create a legally binding contract, as Welwisha sent an offer to form such relations, which was duly accepted by Dowell. Both the parties had to contractual capacity and the terms of the contract were also clear. Due to the presence of a valid offer and acceptance, along with the other elements of the contract, a valid contract was formed in this case. In case Dowell is not appointed as the senior accountant, the firm would be liable for a breach of contract. On the basis of above analysis, it can be concluded that a valid and legally binding contract was created between Mr. Dowell and Dodgy Accounts Associates.
